Clinical FND Audits & Diagnostic Overshadowing

Forensic examination of Functional Neurological Disorder (FND) misdiagnoses, premature clinical classification, and diagnostic overshadowing against objective spinal MRI pathology.

Focus: FND vs Spinal MRI Pathology
Clinical Governance: GMC Good Medical Practice
Legal Basis: UK GDPR Art. 16 (Right to Rectification)

1. The Mechanics of Diagnostic Overshadowing

Diagnostic overshadowing occurs when a patient's physical symptoms are prematurely attributed to a functional or psychological label—such as FND—leading clinicians to dismiss, omit, or delay objective radiological investigations (such as high-resolution MRI spinal scans).

Failure Mode 01

Premature Labeling & Confirmation Bias

Once an initial subjective note of "FND" or "functional weakness" is entered into Electronic Patient Records (EPR), subsequent consulting clinicians frequently rely on prior diagnostic tags rather than conducting fresh objective neurological examinations.

Failure Mode 02

Omission of Objective Radiology

Pathological disc herniations, cord compressions, or radiculopathies identified on subsequent objective MRI imaging are frequently overshadowed or omitted from formal diagnostic summaries due to established FND electronic tags.

2. Legal Rectification & Clinical Audit Trail Workflows

Under UK GDPR Article 16 (Right to Rectification) and GMC Good Medical Practice guidelines, patients have a statutory right to challenge inaccurate clinical coding and demand formal addendums to electronic patient records.

Statutory Requirement: NHS Trusts cannot delete historical clinical entries, but they are legally mandated to append formal clinical addendums and rectifications when objective diagnostic evidence (e.g. MRI reports) contradicts prior subjective FND coding.
